These Terms of Service ("Terms") govern your access to and use of the website located at 
crespoinsurance.com (the "Site") and any related services, content, or features made available through the Site
(collectively, the "Services"). The Services are operated by Crespo Agency LLC, a [state] limited liability company
doing business as Crespo Insurance.


By accessing, browsing, or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is
incorporated by reference. If you do not agree to these Terms, do not access or use the Site.
You must be at least 18 years of age to use the Site. By using the Site, you represent that you are at least 18
years old and have the legal capacity to enter into these Terms.


2. About Crespo Insurance
Crespo Insurance is an independent insurance brokerage. We are licensed to sell insurance products in the
following states: Arkansas, Arizona, Florida, North Carolina, New Jersey, New York, Oklahoma,
Pennsylvania, Texas, Washington, and West Virginia
. Licensure status, license numbers, and individual
producer information are available upon request and are filed with the applicable state insurance commissioners.


Orlando Crespo, the principal agent, holds National Producer Number [NPN].


We offer insurance products in the following lines, subject to availability in your state and individual eligibility:

 

  • Medicare (including Medicare Advantage, Medicare Supplement / Medigap, Part D Prescription Drug Plans,

  • and Dual-Eligible Special Needs Plans)

  • Health Insurance (individual and family plans, marketplace and off-marketplace)

  • Life Insurance (term, whole, universal, and final expense)

3. Important Medicare Disclaimers


3.1 TPMO Disclaimer


"We do not offer every plan available in your area. Currently we represent [# of organizations] organizations
which offer [# of plans] products in your area. Please contact Medicare.gov, 1-800-MEDICARE, or your
local State Health Insurance Program (SHIP) to get information on all of your options." 


The numbers above reflect the actual count of insurance organizations Crespo Insurance currently represents and
the total products offered in the visitor's service area. These numbers are updated as carrier appointments
change.


3.2 Government Affiliation
Crespo Insurance is not affiliated with, connected to, or endorsed by the United States government, the
federal Medicare program, the Social Security Administration, or the Centers for Medicare & Medicaid
Services (CMS). We are an independent, privately operated insurance agency.


3.3 Compensation Disclosure
We are licensed to sell Medicare-related products on behalf of multiple insurance carriers. When you enroll in a
plan through us, the issuing insurance carrier pays us a commission. This compensation does not increase the
cost of your plan. Our commission rates may vary by carrier, plan type, and state. We are required by law to
recommend coverage that is suitable for your needs regardless of carrier compensation, and we will disclose any
material conflicts of interest upon request.


3.4 No Guarantee of Plan Availability or Pricing
The information on this Site is for general educational purposes and is not a complete description of any
insurance plan. Plan details, benefits, premiums, copayments, deductibles, networks, drug formularies, and
coverage rules vary by carrier, plan, state, and individual circumstance, and are subject to change at any time.


Enrollment in any Medicare plan depends on contract renewal between the carrier and CMS. We make no
guarantee that any particular plan will be available, suitable, or affordable for you, or that any plan we discuss will
continue to be offered.


3.5 No Quote, Illustration, or Coverage Commitment
Any premium ranges, sample quotes, plan illustrations, benefit summaries, or pricing examples shown on this Site
are for illustrative purposes only and do not constitute an offer of insurance, a binding quote, or a guarantee of
coverage. Actual rates, benefits, and eligibility are determined by the issuing insurance carrier based on a
completed application and are subject to underwriting, state filings, and carrier approval. Coverage begins only
when the carrier issues a policy and the policy's effective date arrives.


3.6 Official Medicare Information
For official, comprehensive information about Medicare, visit medicare.gov or call 1-800-MEDICARE
(1-800-633-4227, TTY 1-877-486-2048), 24 hours a day, 7 days a week. You may also contact your State Health
Insurance Assistance Program (SHIP) for free, unbiased Medicare counseling.


4. No Insurance Advice; Informational Use Only
The content on this Site, including articles, guides, FAQs, downloadable resources, and similar materials, is
provided for general informational and educational purposes only. Nothing on this Site constitutes insurance
advice, financial advice, legal advice, tax advice, or medical advice.


Insurance products are complex and involve individual factors such as your health status, prescriptions, doctors,
financial situation, and state of residence. You should not make insurance decisions based solely on information
from this Site. To receive personalized recommendations, contact us to schedule a consultation with a licensed
agent.


Insurance availability, premium rates, plan benefits, and eligibility requirements vary by state and individual
circumstances and are subject to change. Information on this Site may not be current, and we make no guarantee
of accuracy at any given moment.


5. Communications Consent (Phone, SMS, and Email)


5.1 Scheduling Consultations
The Site allows you to schedule a free consultation with a licensed agent through our online booking system or by
submitting a contact form. Scheduling a consultation does not create an agent-client relationship until and unless
you and Crespo Insurance mutually agree to engage our services. You may reschedule or cancel a consultation at
any time at no cost.


5.2 Phone Call Consent
By providing your telephone number through any form on this Site, calling us, or otherwise initiating contact with
us, you provide your prior express written consent for Crespo Insurance to contact you by telephone —
including calls placed using an automatic telephone dialing system or an artificial or prerecorded voice —
at the number(s) you provide, for the purpose of responding to your inquiry, scheduling and confirming
consultations, providing requested insurance information, and following up on your interest in our services. 
Consent is not a condition of purchase. You may revoke this consent at any time by notifying us in writing or
verbally.


5.3 SMS / Text Messaging
By providing your mobile telephone number, you also consent to receive text messages from Crespo Insurance
related to scheduling, appointment confirmations, follow-ups, and (if you opt in separately) educational content.

 

Standard message and data rates may apply. Message frequency varies. You can opt out of text messages at any
time by replying STOP to any message. For help, reply HELP. We do not share or sell mobile telephone numbers
or SMS opt-in data with third parties or affiliates for marketing purposes.


5.4 Email Communications
If you provide your email address, you consent to receive transactional emails from us (such as appointment
confirmations and follow-ups). You will only receive marketing or educational emails if you separately opt in. You
may unsubscribe from marketing emails at any time by clicking the unsubscribe link in any such email.


Transactional emails relating to a current consultation or active service relationship may continue regardless of
marketing preferences.


5.5 Recording
For training, quality assurance, and CMS compliance purposes — and as required by federal law for certain
Medicare sales calls — phone and video calls between you and our licensed agents may be recorded. By
participating in a call with our agents after being notified of recording, you consent to that recording. Recordings
are retained per CMS requirements (currently 10 years for Medicare sales and enrollment calls) and protected per
our Privacy Policy.


5.6 Information You Provide
By submitting information through any contact, scheduling, or quote form on the Site, you represent and warrant
that:

  • The information is accurate and complete to the best of your knowledge;

  • You are submitting your own information, or you have legal authority to submit information on behalf of another

  • person (such as a family member or person under your care);

  • You consent to our use of the information in accordance with our Privacy Policy.


6. Intellectual Property and Brand Use
All content on the Site — including text, graphics, logos, photographs, illustrations, downloadable guides, audio,
video, and software — is the property of Crespo Agency LLC or its licensors, and is protected by United States
and international copyright, trademark, and other intellectual property laws.


"Crespo Insurance," "Crespo Agency," the Crespo Insurance logo, and any associated taglines are trademarks
of Crespo Agency LLC. You may not use these trademarks, our agents' names or likenesses, or any confusingly
similar variations without our prior written permission. This includes — but is not limited to — using our name,
marks, or content in:

  • Paid advertising, including Google Ads, Meta/Facebook ads, or other digital ad campaigns;

  • Domain names, subdomains, or social media handles;

  • Materials that imply endorsement, partnership, or affiliation;


Comparative or competitive marketing without our written consent.


You are granted a limited, revocable, non-transferable license to access and use the Site for your personal, noncommercial purposes. You may not:

  • Reproduce, modify, distribute, sell, license, or create derivative works from any Site content without our prior

  • written consent;

  • Use any automated system, including bots, scrapers, or spiders, to access or collect data from the Site;

  • Interfere with the security or proper functioning of the Site;

  • Use the Site or any of our content in any way that violates applicable law or regulation, including without

  • limitation CMS Medicare marketing rules, state insurance commissioner rules, or consumer protection law.


7. Third-Party Links and Resources
The Site may contain links to third-party websites, including insurance carriers, government resources (such as
medicare.gov and healthcare.gov), and educational materials. These links are provided as a convenience. We do
not endorse, control, or take responsibility for the content, products, services, or privacy practices of any thirdparty website.

 

Your use of any third-party website is at your own risk and subject to that site's own terms and
privacy policies.


8. Disclaimer of Warranties
The Site and Services are provided "as is" and "as available," without warranty of any kind, either express
or implied. To the maximum extent permitted by applicable law, Crespo Insurance disclaims all warranties,
including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;

  • Warranties that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful

  • Warranties that any specific insurance product will be available, suitable, or affordable for any particular

Some jurisdictions do not allow the disclaimer of certain warranties, so portions of this disclaimer may not apply to

9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Crespo Agency LLC, its officers, members,
employees, agents, contractors, or licensors be liable to you for any indirect, incidental, consequential, special, exemplary, or punitive damages — including but not limited to lost profits, lost data, lost coverage, or business
interruption — arising out of or related to your use of, or inability to use, the Site or Services, even if we have been
advised of the possibility of such damages.


To the maximum extent permitted by law, our total cumulative liability arising out of or related to these Terms or
your use of the Site shall not exceed one hundred United States dollars ($100.00).


Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded.


10. Indemnification
You agree to indemnify, defend, and hold harmless Crespo Agency LLC and its officers, members, employees,
agents, contractors, and licensors from any claims, damages, losses, liabilities, costs, and expenses (including
reasonable attorneys' fees) arising out of or related to:

  • Your access to or use of the Site;

  • Your violation of these Terms;

  • Your violation of any rights of any third party;

  • Any content or information you submit through the Site.


11. Force Majeure
Crespo Insurance shall not be liable for any failure or delay in performance arising from causes beyond our
reasonable control, including without limitation: acts of God; natural disasters; pandemics; acts of war, terrorism,
or civil unrest; labor disputes; cyberattacks or other malicious acts; outages of internet, telecommunications,
electrical, or third-party service providers (including but not limited to our website host, scheduling tools, and CRM
platforms); failure or insolvency of insurance carriers; changes in law, regulation, or government action; and any
other event of force majeure. We will use commercially reasonable efforts to resume performance as soon as
practicable.


12. Right to Refuse Service
We reserve the right to decline to provide services, refuse a quote or recommendation, or terminate a consultation
or service relationship at any time, in our sole discretion, including (without limitation) where:

  • We reasonably believe a prospect has provided false, misleading, or incomplete information;

  • The prospect's needs fall outside the products, states, or services we offer;

  • Continuing the engagement would create a regulatory, ethical, or compliance concern;

  • We are unable to identify a suitable plan that meets the prospect's needs;

  • The prospect engages in abusive, harassing, threatening, or unlawful conduct toward our staff or partners.


Refusal of service does not create liability for Crespo Insurance, and where appropriate we will refer the prospect
to alternative resources, including medicare.gov, 1-800-MEDICARE, or their state Department of Insurance.


13. Governing Law, Arbitration, and Dispute Resolution
These Terms and any dispute arising out of or related to them or your use of the Site shall be governed by and
construed in accordance with the laws of the State of [state], without regard to its conflict-of-laws principles.


13.1 Informal Resolution First
Before filing any formal claim, you and Crespo Insurance agree to first attempt to resolve any dispute informally by
contacting us at the address in Section 18. We will work in good faith to resolve the dispute within 60 days of
notice.


13.2 Binding Arbitration
Any dispute, claim, or controversy between you and Crespo Insurance arising out of or relating to these Terms,
the Site, or our Services that is not resolved informally shall be resolved by binding individual arbitration
administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect.


The arbitration shall be held in [county, state], or by telephone or video conference at the arbitrator's discretion.


The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent
jurisdiction. Each party shall bear its own attorneys' fees and costs unless the arbitrator determines otherwise.


13.3 Class Action Waiver
You and Crespo Insurance agree that any dispute will be resolved on an individual basis and not as a
class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one
person's claims and may not preside over any form of representative or class proceeding. If this class-action
waiver is found unenforceable, then the entirety of Section 13.2 (binding arbitration) shall be null and void, and the
dispute shall proceed in court under Section 13.4.


13.4 Court Jurisdiction (Where Arbitration Does Not Apply)
For any dispute that is not subject to arbitration — including disputes involving regulatory complaints filed with a
state insurance commissioner, CMS, or another government agency — the federal and state courts located in 
[county, state] shall have exclusive jurisdiction, and you consent to the personal jurisdiction of such courts.


13.5 Regulatory Remedies Preserved
Nothing in this Section 13 limits your right to file a complaint with a state insurance commissioner, the U.S.
Department of Health and Human Services, CMS, the Federal Trade Commission, or any other government
agency, or to pursue any remedy available under applicable law that cannot lawfully be waived.

 

14. Modifications to the Terms
We may update these Terms from time to time to reflect changes in our Services, applicable laws, or our business
practices. When we make material changes, we will update the "Last Updated" date at the top of these Terms and,
where appropriate, provide additional notice (such as a banner on the Site or an email to active clients). Your
continued use of the Site after the effective date of an update constitutes your acceptance of the updated Terms.


15. Termination
We reserve the right to suspend or terminate your access to the Site at any time, with or without cause, and with
or without notice. Upon termination, the provisions of these Terms that by their nature should survive — including
disclaimers, limitations of liability, indemnification, and governing law — will remain in effect.


16. Severability and Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full
force and effect. These Terms, together with the Privacy Policy and any other agreements expressly incorporated
by reference, constitute the entire agreement between you and Crespo Insurance regarding your use of the Site.


17. Accessibility Statement
